Este documento contractual regirá la contratación de rutas turísticas en barco con reserva previa a través del sitio web https://golah.es/, propiedad de Juan José Pérez Camacho, en adelante, PRESTADOR, cuyos datos de contacto figuran también en el Aviso Legal de esta Web.
Aceptación del Contrato
Acceptance of this document implies that the USER:
- Ha leído, entiende y comprende lo aquí expuesto.
- Es una persona con capacidad suficiente para contratar.
- Asume todas las obligaciones aquí dispuestas.

- No se admiten mascotas a bordo
- Salidas según la operatividad meteorológica

POLÍTICA DE RESERVAS
This contractual document shall govern the contracting of boat tours booked in advance through the website. https://golah.es/, propiedad de Juan José Pérez Camacho, en adelante, PRESTADOR, cuyos datos de contacto figuran también en el Aviso Legal de esta Web.
Estas Condiciones permanecerán publicadas en el sitio web a disposición del USUARIO para reproducirlas y guardarlas como confirmación del contrato, pudiendo ser modificadas en cualquier momento por el PRESTADOR. Es responsabilidad del USUARIO leerlas periódicamente, ya que resultarán aplicables aquellas que se encuentren vigentes en el momento de realización de pedidos.
Contracts shall not be subject to any formality except as expressly provided for in the Civil and Commercial Codes and in this or other special laws.
Acceptance of this document implies that the USER:
- Ha leído, entiende y comprende lo aquí expuesto.
- Es una persona con capacidad suficiente para contratar.
- Asume todas las obligaciones aquí dispuestas.
Estas condiciones tendrán un período de validez indefinido y serán aplicables a todas las contrataciones realizadas a través del sitio web del PRESTADOR.
El PRESTADOR informa de que el comercio es responsable y conoce la legislación vigente de los países a los que ofrece sus servicios y se reserva el derecho de modificar unilateralmente las condiciones, sin que ello pueda afectar a los bienes o promociones que fueron contratados previamente a la modificación.
Identidad de las partes contratantes
Por un lado, el PRESTADOR del servicio de reservas de rutas turísticas en barco contratado por el USUARIO es Juan José Pérez Camacho, con domicilio social en C/ 25 de noviembre, Bloque 3, Casa F – Conil de La Frontera – 11140 (Cádiz), NIF 75818761C y con teléfono de atención al cliente/USUARIO 621182185.
Y por otro, el USUARIO, responsable de la veracidad de los datos personales facilitados a Juan José Pérez Camacho.
Objeto del contrato
El presente contrato tiene por objeto regular la relación contractual entre el PRESTADOR y el USUARIO en el momento en que este acepta, durante el proceso de contratación en línea, la reserva de la ruta turística en barco seleccionada por este último.
La relación contractual conlleva la reserva de un servicio determinado, por un tiempo limitado, a cambio de un precio determinado y públicamente expuesto a través del sitio web. Los servicios extra se deberán contratar en el momento de realizar la reserva.
Procedimiento de contratación
El USUARIO, para poder acceder a los servicios ofrecidos por el PRESTADOR, deberá ser mayor de edad. Para ello, el USUARIO deberá proporcionar de manera libre y voluntaria los datos personales que se le requerirán, los cuales se tratarán de conformidad con lo dispuesto en el Reglamento (UE) 2016/679, de 27 de abril (GDPR), y la Ley Orgánica 3/2018, de 5 de diciembre (LOPDGDD), detallado en el Aviso legal y la Política de privacidad de este sitio web.
In accordance with the requirements of article 27 of Law 34/2002, on Information Society Services and Electronic Commerce (LSSICE), the contracting procedure will follow the following steps:

14. Observaciones. - CLÁUSULAS GENERALES DE CONTRATACIÓN
Unless otherwise stipulated in writing, making a reservation with the PROVIDER implies acceptance by the USER of these legal conditions. No stipulation made by the USER may differ from those of the PROVIDER if it has not been expressly accepted in advance and in writing by the PROVIDER.
- BOOKING AND PAYMENT
The PROVIDER will previously inform the USER about the procedure to follow in order to book the chosen tourist route.
The automatic system for calculating availability and prices allows the USER to choose the tourist route he/she is interested in and immediately pay the price of the reservation online.
The PROVIDER will not reserve the corresponding place for the chosen route until it has verified that payment has been made. Once payment has been verified, the PROVIDER will contact you by email to confirm the booking. This term is understood as long as availability has been confirmed.
- CANCELLATIONS (right of withdrawal)
The USER has the same rights and deadlines to proceed with the cancellation and/or claim for possible defects or flaws in the reservation, both online and offline.
Any cancellation must be communicated to the PROVIDER by e-mail to golahconil@gmail.comindicating the corresponding reservation number.
- Cancelación por parte del USUARIO/CLIENTE.
The client is entitled to a full refund of the amounts paid, except for the cancellation costs of the booking, which represent 10% of the value (up to a maximum of €5 per person), provided that notice of cancellation is given up to 48 hours before the activity is due to take place.
In the event that the client communicates the cancellation between 48 hours and 24 hours prior to the activity, he/she will be entitled to a refund of 50% of the total amount paid for the activity booked.
In the event that the client communicates the cancellation within 24 hours prior to the activity, no refund or reimbursement of the amounts paid for the activity booked will be made.
The ‘GIFT CARDS’ will not be refundable for their amount. Once the ‘Gift Code’ has been used to make a route booking, if it is cancelled up to 48 hours before the activity takes place, the same code will be reactivated so that it can be redeemed within the current year.
If the ‘Gift Card’ is cancelled within 48 hours prior to the activity, no refund will be made and no new ‘Gift Code’ will be provided, losing any right to claim or to carry out the activity.
The right to any refund or reimbursement shall also be forfeited in the following cases:
-Uncomfortable or inappropriate behaviour towards other users during the activity.
-Failure to show up at the agreed time at the agreed place for the activity.
-Voluntary abandonment, once the activity has started.

Golah undertakes to carry out the entire contracted service, with the characteristics and conditions stipulated in each route.
In the event that the company is obliged to significantly modify any essential element of the activity, it will contact the person who made the reservation through the channels indicated by the USER.
In the event that the company is forced to cancel the route before the departure date, for any reason beyond the client's control, the client will be entitled to a full refund of all amounts paid for the cancelled activity, within a maximum period of 10 working days.
The ‘GIFT CARDS’ are non-refundable. Once the ‘Gift Code’ has been used to make a route booking, if Golah Charter is forced to cancel the activity, the same code will be reactivated so that it can be redeemed, within the current year, communicating it by email (or by telephone if indicated in the booking) as soon as possible.
If the activity booked does not have the minimum capacity of 5 people, the PROVIDER may opt for operational cancellation, informing the user within 24 hours prior to the activity booked, offering him/her:
-An alternative route.
-La devolución total de todas las cantidades satisfechas de la actividad cancelada, en un plazo máximo de 10 días.
- RECLAMACIONES Y RESOLUCIÓN DE LITIGIOS EN LÍNEA

Si durante el periodo de alquiler se produjese alguna avería, el USUARIO deberá avisar de inmediato al PRESTADOR para resolver lo antes posible estas incidencias.
Resolución de litigios en línea (Online Dispute Resolution)
In accordance with Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for online dispute resolution between the USER and, without recourse to the courts of law, through the intervention of a third party, called a Dispute Resolution Body, which acts as an intermediary between the two. This body is neutral and will dialogue with both parties in order to reach an agreement, and may finally suggest and/or impose a solution to the conflict.

- FORCE MAJEURE
The parties shall not be liable for any failure due to force majeure. Performance of the obligation shall be delayed until the cessation of the force majeure event.
In this sense, in order to guarantee safety and avoid any danger to the physical integrity of the users or the boat, the PROVIDER reserves the right to cancel the reserved activity in the following cases:
-Warnings for heavy rain or wind in the area, at the time of the booked activity.
-Possibility of fog, in the time frame in which the booked activity will take place.
In these cases of cancellation, the PROVIDER will make a full refund to the client of all amounts paid for the cancelled activity, within a maximum period of 10 working days.
- COMPETENCE
The USER may not assign, transfer or transfer the rights, responsibilities and obligations contracted.
If any provision of these terms and conditions is held to be invalid or unenforceable, the validity, legality and enforceability of the remaining provisions shall not be affected in any way, and shall not be modified in any way.
The USER declares that he/she has read, knows and accepts these General Conditions in their entirety.
- GENERAL INFORMATION ABOUT THE OFFER
The details of each booking are provided to the USER in the respective description on the website.
Todas las reservas efectuadas por se entenderán sometidas a las presentes Condiciones Generales.
No modification, alteration or agreement contrary to Juan José Pérez Camacho's Business Proposal or stipulated herein shall have any effect, unless expressly agreed in writing signed by Juan José Pérez Camacho, in which case, these particular agreements shall prevail.
Due to continuous technical developments and product improvements, we reserve the right to make changes to the information provided in our advertisements, insofar as this does not affect the value of the services offered. These changes shall also apply in the event that, for whatever reason, the possibility of supplying the services offered should be affected.
- PRICE AND PERIOD OF VALIDITY OF THE OFFER
Los precios que se indican respecto de cada reserva incluyen el Impuesto sobre el Valor Añadido (IVA). Estos precios, a menos que se indique expresamente lo contrario, no incluyen seguros o cualesquiera otros servicios adicionales y anexos a los artículos adquiridos.
The prices applicable to each item are those published on the website and are expressed in EURO currency. The USER assumes that the economic valuation of some of the services may vary in real time. Prices may change on a daily basis until the reservation is made.
Todo pago realizado a conlleva la emisión de una factura bajo consentimiento (art. 63.3 RD 1/2007) a nombre del USUARIO registrado o de la razón social que este haya informado en el momento de realizar el pedido. Esta factura se entregará al USUARIO cuando finalice el alquiler y se efectúe el pago de los servicios contratados. En caso de querer recibirla mediante correo electrónico, deberá solicitarlo por cualquiera de los medios que el PRESTADOR pone a su disposición, informándole de que en cualquier momento podrá revocar dicha decisión.
TRANSPORT COSTS
There are no transport costs.
- PAYMENT METHODS, CHARGES AND DISCOUNTS
The PROVIDER is responsible for the economic transactions and offers the following ways to pay for an order:
- Tarjeta de crédito.
The USER may use a discount coupon prior to the completion of the purchase if he/she has received one from the PROVIDER.
Security measures
The website uses information security techniques generally accepted in the industry, such as SSL, data entered on a secure page, firewalls, access control procedures and cryptographic mechanisms, all with the aim of preventing unauthorised access to data. To achieve these purposes, the USER accepts that the PROVIDER obtains data for the purpose of the corresponding authentication of access controls.
The PROVIDER undertakes not to allow any transaction that is or is considered illegal by the credit card brands or the acquiring bank, which may or has the potential to damage their goodwill or negatively influence them.

- PURCHASING PROCESS
You can add any product from our catalogue to your basket. In the basket, only the items, quantity, price and total amount will be displayed. Once the basket has been saved, taxes, charges and discounts will be calculated according to the payment and shipping details entered.
The baskets do not have any administrative link, it is only a section where you can simulate a budget without any commitment on both sides.
From the basket, you can place an order by following the steps below to complete it correctly:

Once the booking has been processed, the system instantly sends an e-mail to the PROVIDER's management department and another to the USER's e-mail confirming that the booking has been made.
- UNBUNDLING AND SUSPENSION OR TERMINATION OF THE CONTRACT
If any of these terms and conditions shall be deemed unlawful, void or for any reason unenforceable, then that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining conditions.
The PROVIDER may, without prior notice, suspend or terminate the USER's access to its services, in whole or in part, for any valid reason, including, without limitation, where the USER fails to comply with or follow any of the obligations set out in this document or any applicable legal provision, licence, regulation, directive, code of practice or usage policy.
When the PROVIDER exercises any of its rights or powers under this Clause, such exercise shall not prejudice or affect the exercise of any other right, power or remedy that may be available to the PROVIDER.
- APPLICABLE LAW AND JURISDICTION
These conditions shall be governed by or interpreted in accordance with Spanish legislation in all matters not expressly established. Any dispute that may arise from the provision of the products or services covered by these Conditions shall be submitted to the courts and tribunals of the USER's domicile, the place of fulfilment of the obligation or the place where the property is located if it is immovable.
- REMARKS
The PROVIDER, prior to carrying out the activity, provides the following indications:
- It is recommended to be at the meeting point at least 10 minutes before the start of the booked activity.
- Carry identity papers.
- Do not forget sunscreen.
- Pets are not allowed on board.
- -Departures according to weather conditions.
